Children born outside the UK to an ILR parent

Post by Ahmad0123 » Sat May 09, 2026 12:44 am

Hi all,
I am new here and posting for the first time.
I have got a query if anyone could assist please regarding my children born outside the UK.
I am a British citizen and want to sponsor my wife and children.
I had an ILR when my children were born outside the UK.
I need to apply for family visa for my wife, is there any way I could fast track my children citizenship/registeration or do I need to follow the same process for them as dependents as the fees are quite high?
Thank you in advance

Your children follow the same visa route as your wife.

No fast track route for them unfortunately.

Were the children born before or after the date on your naturalisation certificate?

If after the date of your naturalisation certificate,
- they are British citizens by descent and can apply for a British passport.

If before the date of your naturalisation certificate,
= As stated by CR001, the children will follow the same immigration pathway as the second/less-privileged parent, will need to apply for ILR with the second parent and then will be eligible to register as British citizens, at least as per the current rules.

The government has suggested that the rules on ILR and citizenship may be tightened and therefore their route may vary.

Thank you for your reply. I was wondering if it will be appropriate instead of including my children as dependents in my spouse's visa application, I apply for them as Indefinite leave to Enter? Will need some suggestions on that please.
Thank you

Just to add one of my child is special needs, if that will have any impact on the application?

You can't. They will flow the same visa route and ILR after years as your spouse.

Indefinite Leave to Enter is only possible if both parents have ILR already.

(a) It's not your choice as to what status your children get. They will get the same status as the other/second parent. As mentioned by CR001 above, ILE is possible if both parents have ILR or British citizenship. It is still the same logic; the status of the second/less-privileged parent.

Also, to the best of my knowledge, there is no separate form for ILE. You make the same application for your children. It is up to the Home Office which visa they issue. In this case, they will look at the second parent's status and issue the appropriate visa.

(b) Special needs is irrelevant with regards to grant of ILR. Once the child is in the UK, they will get the same treatment for their special needs regardless of whether they are in the UK on a dependent visa or ILR.
