Hi everyone

I just got my refusal letter today.

Here is my case details:

Applied on 22 august 2004

Reference number 0253**

Urgent Treatment request sent in on 5 July, 2005

Got decision dated 13 July

Points claimed 65

Age Under 28 - 5 points claimed and got them

Education - ACCA affiliate membership claimed 25 got 25 points

Work experience: claimed 35 alloted 0 points.

Now in this section they have given strange reason for not accepting my application. i have two experience letter from two employers totalling 4 yrs and 1 months worth of graduate level experience. For one of them the caseworker has said that i was studying in UK for ACCA hence the experience letter cant be accurate. She had no idea that u gain the ACCA qualification from different parts of the world and u dont need to be in UK for that. I talked to her and she has said that i need to get a letter from ACCA stating that i took my exams in Pakistan and it shud be sufficient to prove that i was in pakistan during this time and the letter is orginal. For the other experience letter she has asked for a detailed description of job responsibilities etc which i wasnt able to get when i was applying. I am trying to get that.

Now i have a question if everyone could help me out.

1 The Case worker said that ill need to send in a fresh application as i would be presenting fresh evidence. Would this mean that i would have to send in my original documents again?

2 I read about something called a paid review. Will this be a paid review or a fresh application? and how would it be treated

3 During this time period i have gained further experience and would everyone recommend i send in evidence relating to that as well to beef up my period of work experience? and if i do which process would be quicker in ur opinion. A paid review or a fresh new application

Would be grateful for everyones input on this as i am confident that i can get the necessary points to be successful.

sorry to hear about your refusal, but it's good that you got to talk to your caseworker and know exactly what documents you need to provide this time.

in answer to your questions,

i think if you go with paid appeal, you don't need to submit original documents, just the additional ones. just provide the ACCA letter and the detailed job description. include with it a letter explaining why the 35 points should be awarded. send a copy of their letter to you (to be safe) so they know there's no need to re-evaluate the other sections.

fresh application - send everything again. you get the additional year of work experience and if you are still under 28 now, your application is stronger.

time scales - from what i've read on this board, both options for you would take around the same time. people who have sent second (fresh) applications seem to be put on a different queue as first time applicants, and the 2nd time ones are taking longer. appeals are also taking longer.

how frustrating ...that it has been rejected bcos they were not aware that ACCA can be taken up even outside the UK

I am a CA from India ...can u please tell me ..were any points awarded for your CA from pakistan ...
i am not sure whether they will consider Indian CA as equivalent to ACCA and give me 25 points or not ...
i think u shud go in for a paid review instead of fresh appln as u are correcting the loopholes they have pointed out through extra documentation ...but in a fresh application . they may once again come up with fresh queries . :?

thanks for the advice Bani and Vadya on whether i shud go for a paid appeal or a fresh application. Im also more inclind towards a paid appeal rathar than a fresh application as i fear that they will raise fresh querries on the latest experience.

Vadya i dont know whether an Indian CA is considered equivalent to a Masters level or not. So i cant say whether u can claim master level points for that. What is the status of indian CA vis a vis getting membership of ACCA. If u could check that out on ACCAs website u wud be able to assess properly how many points u can claim for ur Indian CA.

Anyway thanks everyone for the advice and am looking for still even mor eadvice on my problem.

Dont get confused with Paid Appeal and Fresh Application

You definitely have to submit all the documents with your Fresh Application (the ones you sent earlier too). There is no such thing like Paid Review. If you read your refusal letter again you will find that Home Office advises to either go for a review (un paid within 28 days) or make a fresh application (with no restriction of 28 days).

In your case you will have to make a fresh application with your detailed job description for both the jobs and a proof that you finished your ACCa from your home country.

Paid Appeal - means that the review period remains the same as of your original application but you need to pay new fee.
e.g If in original docs, you have sent income proof's from feb'04 -feb '05 and you get your decision in july. In case of paid review your review time will still be the feb '04 - feb '05 and in case of fresh application it will be July 04-July '05.
