Tier 1 Extension

Post by my_query » Wed Nov 17, 2010 9:18 pm

Hi,

Could you please answer the following query:

I have a Tier 1 (General) Migrant Visa valid from 24 May 2010 to 24 May 2012. I have an offer from an India based company to work as an onsite employee in the UK. As a result of which I will be exempt from paying National Insurance for first 2 years of my service.

My query is --> Will not paying National Insurance cause a problem when I have to apply for an extension later.

Thanks,

vinny

Are you sure you're going to be exempt from NI?

Aside from whether you should be paying it or not, this would not currently be an issue, however it could be at some time in the future.

2.3 The report states that checks were not undertaken with other government agencies e.g. NHS, benefits and tax/NI records. None of these is currently standard practice in any visa operation. The UK Border Agency is currently exploring how such checks, which require the cooperation of other agencies, can be put in place routinely and what resource implications they have.

Will you be paid salary in India, and only allowances in the UK - like they do with sponsored (Tier 2) migrants? If so, do remember that at the time of extension, you cannot apply multiplier factor to earnings made / credited overseas.

Hi..Yes I'm certain that I will not have to pay NI for first 2 years and tax for first 2 months.

Hi..I will be paid salary in UK itself just like other employees of any UK based company. The only difference would be not paying NI. Could this lead to an issue later during applying for extension?

Thanks for your response!

Hi..Thanks for your response! My concern is whether it could lead to a rejection while applying for extension. Have consulted with a few friends who already have got extenson here, according to them only the payslips are required and it does not matter whether you have paid or not paid NI. But I need to confirm. I have emailed the home office as well. Lets see.
