Proof of Maintenance funds overlooked

Proof of Maintenance funds overlooked

Hi Guys,

My wife's visa as HSMP Tier 1 dependent got rejected with a reason for unavailability of funds. Although I provided the non UK bank statement but they have totally overlooked it.

I have already appealed but is it advisable to reapply?

Is it a problem if one have been living in UK for more than 12 months and shows his bank statement from back home, because as for my understanding you can show your funds from anywhere in world?

Details:
I have been living in UK for more than 6 years and got married April 2011, applied for my wife visa on 10th of May 2011. Home office refused visa in third week of June 2011 with an objection on maintenance funds.

I provided three banks statements - two banks from UK and another one from Pakistan.
1. HSBC bank statement as proof of income
2. LLoyds TSB as proof of funds covering two weeks from end of Jan 2011 to second week of Feb 2011. Then realized that I wouldn't be able to get my third month bank statement by the time I would travel to Pakistan. So I started to maintain funds in AJK bank in Pakistan.
3. AJK bank statement, a state owned bank in Pakistan, as proof of fund covering 1st of February to 3rd of May (90 days)

They refused dependent visa with a strange reason that her sponsor didn't have enough fund in neither in HSBC nor in LLoyds bank account, and there is no trace of AJK bank statement at all in reason to refuse - which shows me like they have overlooked it.

Do you think if its because they overlooked bank statement?

if the bank statement was in your name then i cannot see any reason for them to reject it as long as it had enough funds in it.

i would appeal though it takes time.

Yes bank statement was in my name and I maintained more than £2500 in my funds for three months, and this statement was issued 10 days before we applied for visa i.e. less than a month.

In their refusal statement they said that I couldn't maintain £533 in my UK bank accounts ( i.e. HSBC and LLoyds) and there is not a single statement/argument about third bank statement as if they have over looked it.

What was the purpose of providing the Lloyds TSB bank statement? This is probably what caused the confusion. Just appeal, don't reapply. You are within the rules and will not be submitting any new evidence...

AJK bank? There is a chance that UKBA may not consider it as a bank.

Actually I started to maintain funds in LLoyds tsb initially but soon I realized that by the time time I would travel to back home my third month bank statement wouldn't be in my hand ( my bank statement comes on 20th and I had to fly five days before that). So I started to maintain funds back home.

I supplied Lloyds tsb bank statement just an extra supporting document.

Lloyds was covering funds from 20th of January to 10 of Feb 2011 and AJK bank statement was for a period from 1st of February to 3rd of May 2011.

AJK bank is a state owned bank. http://bankajk.com/results.phpp

I confirmed this with bank staff if their statements are acceptable to UKBA, and they confirmed that it is acceptable.

HOVictim, what is your update? what have you done?
I am in the same situation...I had provided Lloyds statement along with my payslips (to show that the salary amount is being deposited in my account) and showed ICICI bank statement for funds maintenance. This was also clearly mentioned in the cover letter, but unfortunately, ECO overlooked and considered LLoyds statement and rejected my application station insufficient funds..

I first considered 'administrator review' but they refused to consider under that as according to home office thats only for the main applicant.

On the second try I have sent the appeal and expecting a reply from them in October.

Its a painful process.

I did paper one in mid of July 2011 and they have replied me last week on 08/09/2011 to submit the passport again.

They havent said that we will issue visa but the statement is "UKBA aim to process allowed appeals within 8 weeks of official notification of the determination. Because we may need additional information or to assess whether there have been any significant changes in your circumstances since the original decision, we have yet to make a final decision on your application. But supplying the information below, making these arrangements and providing your passport as soon as possible will assist us in progressing your case more quickly. There will be no additional charge for this service.

We are able to post date visit visas for up to three months so it is important therefore that you contact us as soon as possible even if you do not intend to travel straight away"
