The question is asking the applicant if he did something; it's not asking if he did something, but only under his real name. If I kill someone while calling myself John Smith it does mean I can deny doing it because my name is not John Smith. Of course he must respond to all the questions that are asked of him rather than assuming they don't apply to him if he used a fake identity. If he thinks or acts otherwise he is heading for serious trouble.hope1981 wrote:Hiya
Looking to get married in Albania and then apply for spouse visa for partner who has overstayed his visa and is going back of his own accord, been together over 3 and half years, home owner with no debt, over 30k per year job and plenty savings however...............
1. On the form it asks if you have had NHS treatment, my partner has however used his brother NI number and his name and its registered to my address which would be his permanant residience? Should he declare this on the form.....what checks do they do? no probs paying so long as it doesn't affect decision???
2. He has been working self-employed using and his brothers NI ....should he say he is employed and provide all his payslips want to be honest but at same time scared of refusal :(
3. Using a fake passport he got a driving licence then he tried to apply for NI which he was asked to collect passport we knew so he didn't go this was at our address! What should he say about this on form and where as I assume when they check his name against our addy and this will defo come up? Also will they refuse because of this?
4. His real passport was taken from him when he was in a fight and he failed to sign in hence his overstay, his solic said he wasn't charged so what should he declare around this and where?
Thanks in advance for any advice feel helpless just know about what to do!

So in essence he should state he used the NHS and state that he was employed and supply the pay slips as they are in his name.
Not sure about the have you been charged question as it never got that far due to him not signing in however his solic said the evidence ie video footage shows he was innocent and provoked from the other person?
Is there somewhere on the form about using fake docs though?
Only if the form asks for this information. I can see a question asking about NHS treatment but nothing about employment as an overstayer. Furthermore, I don't know why the payslips would be needed. Please be aware that the form is asking specific questions rather than asking the applicant to tell a story in their own words.hope1981 wrote: So in essence he should state he used the NHS and state that he was employed and supply the pay slips as they are in his name.
Was just asking. Learning from this you see.hope1981 wrote:its a good question so dont worry! my partner has been working using his bris ni etc and his own name not sure if to delare employed as monies going into his bros account and tax all paid in bros name as self employed! his bro wasnt working so in two minds ??
I've said that the application from asks certain questions, and those questions must be answered honestly and correctly. I also said that openly volunteering information that is not asked on the application form is not necessary. However, anyone is free to do so if they think it will help rather than hinder.Assist_ark wrote: To answer your question, from what Lucapooka said, think he should state he worked and the amount he earned.
"Are you employed" should not be confused with "Did you work in the UK". Saying so because, the former is current, while the latter is past tense. The former is nothing to be worried about, since he is not presently working, then say "no". Which means he is not earning any monney. But the latter, asks if he has worked, which from what Lukapocka has said, should be "yes". But, based on you, since it wasn't his name, then he didn't work.hope1981 wrote:your opinion is valued and it was just what i was thinking and the question only asks are you employed so technically not asking were you employed unlawfully also his brother is now working that same job now he is away ahhhh so many tears for him going fingers crossed be together soon x
