Tier 2 General: When can I apply for extension?

Greetings,
My Tier 2 General visa is going to expire around March 2013. When is the earliest I can apply for an extension? I could not find anything about this in the Border Agency web site.

Provided you are eligible to apply for an extension of your leave you can only do so once a sponsor assigns a CoS to you and within 3 months of the date of assignment.

Could you please clarify this just a bit? Do you mean that the CoS needs to be assigned within 3 months of the expiry date of my current visa?

Or do you mean that my sponsor can assign a CoS say next month, and I can apply within 3 months of the assignment date of CoS?

The thing is, I'd like to apply for an extension around October, but that is 4 months before the end of my current visa.

The 3 months bit is a bit confusing for me :)

A CoS is only valid for 3 months from the date it is assigned. If it is not "used", i.e. if no application for leave is made within the 3 month period, then the CoS expires.

As per the guidelines, you cannot apply for extension 3 months before the visa expiry and once COS is assigned you have to use that COS within 3 months. I hope that makes clear

It appears I've missed that bit.

The section you've referenced is about the earliest and latest dates of the CoS to be assigned though. Maybe I'm failing to see it, but do you know where is the doc/section that sets the 3 month limit related to current visa?

You cannot apply for extension 3 months before the start date in your COS , which would be the expiry date of your current visa

or you can apply now but the start date on your COS should be 3 months from now on, i hope that makes clear

Yes they can.

There is some confusion running in this thread becasue you didn't explain what exactly you want to achieve and why.

The timing of your extension application also has a bearing on ILR provided you want to apply for one eventually.

You're right. I've tried to avoid a long question, but I'm afraid I've failed to express my goals. Here we go then:

My current tier 2 visa, granted in 2010, will expire on February 2013. This is a 3 year visa. My sponsor is going to extend my visa, and normally the process would be aligned so that my extension application would be made around December 2012, before Christmas, or early January 2013

However, my wife, who is on Tier 1 at the moment is going to become dependant on me, and her current Tier 1 will expire earlier than my visa. I was hoping we could apply for an extension for my visa, and at the same time she could become dependant on me.

This must be done before her visa expires, so I'm trying to find out if I can apply for an extension around October, 4 months before my current visa expires.

I have about 18 months of work permit based employment prior to my tier 2 visa, and as far as I know, I can include that time for ILR. Even if I don't include that time for ILR, I should get a 3 year extension due to new rules, which would let me complete 5 years with tier 2, even if I apply 4 months early to an extension.

Is it clearer now? I guess your response means that I can apply for an extension in October, before my wife's visa expires.

there is nothing to stop you applying for an extension in October provided you have a CoS at that time

I had been struggling with the question in the topic for long until I my extension was finally approved last week. So I would like to come share or rather verify the answers provided by the forum gurus previously.

1. You can apply any time up to the day preceding the expiry date of your current leave. (manci)
2. You cannot apply for extension 3 months before the start date in your COS - usually this would be the expiry date of your current visa. (david1955)
3. But if you do apply more than 3 months before your current expiry date (my case 6 months!), you have to remind your HR to put an earlier start date so it is within 3 months of the date COS assigned.

Hope this helps :)
