No further action NFA and its impact on ILR ?

Post by londener » Sat Apr 06, 2013 11:21 am

Dear all,

I almost have been able to sort out my criminality threshold as per the change on 13th Dec. 2012.

Now I have my PNC check with me.

It says disposal NFA-no Further Action.

Fellows, does this offence fall under the ground of refusal for ILR Tier-1 ,according to the statement changes in Dec. 2012.
I mean does this NFA also falls under the period of 24 months ?

Thank you for your advise and sharing.

What were the offences you committed and when did you commit them?

Hi Alanwong,
I am thinking to apply in this June but the NFA date was in September 2011 so a little bit confused.
Anyway I comeback with outcome.

Dear friend,
It was happened in September 2011, I am due to apply for ILR in coming June.
The incident was my partner reported police that I abused her over telephone.

Police statement/offence as per (PNC) shows ,sending a letter or other article conveying false information.
Please let me your thought. And other seniors are also appreciated to put forward their thoughts or facts.

My understanding is that he was cautioned.
I think he still has a high chance of getting ILR according to others' experience. Unless the practice is changed after 6th April.

Since the rules change of 13 December 2012, an application for settlement will be refused where the applicant has within the 24 months preceding the date of the application, been convicted of or admitted to an offence and received a non-custodial sentence or other out of court disposal recorded on their criminal record. This includes a police caution. But as the OP is not answering the questions it's impossible to tell what happened.

Hi fellows ,
PNC shows that , NFA- no further action.Offence stated that sending a letter....as above.
I think it is not a caution as it says no further action.
I am not sure that how do I know which offence is criminal and which not ?

I mean it is not included in a CRB check but included in a PNC report.Just wanted to know if a PNC is a criminal record or not as per the immigration change in December ,2012?
Is every arrest considered a criminal offence though it say no further action and just was for queries?
Let us share

Indeed, NFA means no action taken by the police thus no offence.
