u copied the wrong link,it doesn't concern eu/eea citizens but German and settled persons only.latansingh wrote:Hello,
I am British and i am working in Germany for the last 9 months, i would like to bring my parents to UK. I have read the Singh Route, i am confused with the EEA permit because it states family members except spouse need to know German Language. Is this true?

yeah i see ,but what i don't understand is,if u want to apply for a family permit from germany, then why do u have to go to the link you provided ,..??if u want to apply for a family permit then u should go to the ukba website and apply from there,u need just to go to *apply online* option and you will get there eventually...u will find the right form there which is in this link below:latansingh wrote:Hello,
I understand the process, as you can see i have not attached the correct checklist. The reason for this is i am not able to find a EEA Family Permit form on the Indian Dilpo Site. I have been going crazy as i cannot find appropriate forms or/and checklist.

PS:the link u provided is from the german embassy in india(mumbai)..i guess i'm beginning to understand, maybe your parents are still in india and u want to get them to germany first then to the uk..!!i suggest then if its the case,u need to explain clearly your case next time so people can advice u accordingly.. if its not the case then ignore my last remark.
FAMILY PERMIT is an entry clearance visa to the UK only, what u are looking for maybe is a chenggen visa class C (90 days)for your parents, then u can apply for residence card once they are with u.
I am in the same situation. I am planning to move to France and exercise my treaty rights by self employment. My mom currently holds UK visitor visa. She will visit me in France on schengen visa. once there I will apply for her EEA family member resident permit. She will reside with me in France for 3-6 months.Jambo wrote:Your parents need to move to live with you in Germany to be eligible to use Surinder Singh route. So they need a visa for Germany. EEA Family Permit is a UK only visa. For Germany, they need a Schengen visa. You will need to prove they are financially dependant on you if apply under EEA rules.
After living in Germany with you, and once you plan to move back to the UK, they can apply for a EEA Family Permit to move to the UK. The application can be made in Germany.
Can some one help please.jinkazama_11 wrote:I am in the same situation. I am planning to move to France and exercise my treaty rights by self employment. My mom currently holds UK visitor visa. Now my question is
1)- When I will come back to UK can she travel with me as she got UK visitor visa? Once in the UK can she apply using EEA2 form by following Surinder Singh route.
2)- If she can't travel as mentioned in my question 1 then she have to apply in France. But in the form vaf5 "Surinder singh" criteria isn't mentioned. What we have to do in this case.
3)- I have been told that living together in other member state (France in my case) is only mandatory for spouse and its not mandatory for parents.
Your assistance will be greatly appreciated.
I have asked a solicitor over the phone and he mentioned that living together is only applicable to spouse and I should exercise my treaty right for a minimum period of 6 months.Jambo wrote:1. Yes she can.
3. Who told you that? The parents will need to live with you in France.
to be regarded as exercising treaty right u need to be deemed as a worker and economically active, meaning to use this route u need to prove to them that u exercised your treaty rights, and there is no minimum set of time required..to be deemed as a worker under eu laws,u need to be working for a minimum of 10 weeks and working 12 hours a week is sufficient..only then u will be regarded as a worker under the directive,so i don't see why this *lawyer* is saying otherwise..just asked him to print out the law/directive where it says u need to be working and exercising your treaty rights for 6 month.jinkazama_11 wrote:I have asked a solicitor over the phone and he mentioned that living together is only applicable to spouse and I should exercise my treaty right for a minimum period of 6 months.Jambo wrote:1. I am not sure if it is necessary to live there for 6 months with my mom.
Thanks Jambo for very valuable information, much appreciated.
