divorce is not finialized

Post by mjbevan » Sat Jun 21, 2014 4:39 am

I am in the process of putting together the paperwork of my Family Settlement Application Form, VAF4A and found out that my divorce was never finalized. I started the process of getting divorce again and this time I am handling this so it does not matter if my ex-wife does not file the last bit of paperwork. I am wondering if I should wait the time for it to be finalized to submit the visa application or is it enough to send the original of copies of the divorce proceeding which she filed and then sending my copy of what I filed. . I want to get to the UK as soon as possible to be reunited with my fiancee and my dog.

If you are wanting to join your fiancee, I assume you will be applying for a fiancee visa. They are issued for a 6 month period solely for the purpose of you getting married in the UK.

The home office will not take into account whether you are in the process of being divorced, all they want want to see is the final decree absolute showing your are divorced and free to re-marry. As such, applying while you are going through the divorce process, even if it is at its final stage stand a fair chance in my opinion of the application being refused as you are not yet free to re-marry.

My advice would be to wait and get your final divorce papers from the courts and then apply afterwards submitting the documents.
