Query regarding spouse visa - ILR vs Citizenship

Post by Suj0303 » Wed Apr 03, 2019 4:22 pm

Hi, I hold Indian passport with ILR (since Oct 2018) and will be eligible to apply British Citizenship in October 2019 after I complete 1 year since ILR was granted.

My girlfriend is in India and we are planning to get married in August this year.

1. Are there any benefits to wait for my British Citizenship and then get married?

2. I have been hearing that she will be eligible for her ILR after 5 years if we get married while I hold ILR and 3 years if I am a British Citizen. Is this valid? I did not see any information about 3 years ILR on gov.uk site.

3. What is the exact name of dependant visa I will need to apply.

4. Are 6 months payslip and 1-3 months bank statement okay to prove finances.

Any help will be appreciated.

Thanks in advance,
Suj

No benefits. It is the same visa she applies for whether you hold ILR or are British and the exact same requirements to be met.

She needs ILR which takes 5 years. To apply under Section 6(2) of the Nationality (spouse of British citizen), it requires 3 years residence AND holding ILR (more difficult to change nationality laws than immigration rules. This 3 year Citizenship law goes back to before July 2012 when spouse visas were issued for 2 years and then 1 year ILR).
3. What is the exact name of dependant visa I will need to apply.
Spouse Settlement visa.
4. Are 6 months payslip and 1-3 months bank statement okay to prove finances.
You need a minimum of 6 months payslips and the 6 months corresponding bank statements and a letter from your employer.

I believe CR001 intended to write that ILR takes 5 years.
