Spouse Visa - First Renewal

Post by FXR_1340 » Thu Dec 05, 2019 1:53 pm

Becoming a bit (unnecessarily) anxious about Spouse Visa renewal. I want to get the (correct) date in my diary to ensure renewal at the correct time.

The Spouse Visa was issued

15 May 2018 (Expiry 15/01/2021?)

My wife arrived in UK from USA
04 June 2018 (Expiry 04/02/2021)

Date to submit for Visa renewal FLR (M)?
15 January 2021?

or

04 February 2021?

Or neither.

Grateful for confirmation of the correct date.

Thanks

She should apply for an extension within 28 days of reaching 30 months residence, counted from the date she ENTERED the UK and not the visa issue date.

Thank you so much.

I can now go away, get my calander out and calculate the correct date. Then I will stick that date in my diary.

Thank you.

Thank you. Much appreciated.

I read on here about having to be in UK for a certain number of months to ensure meeting the ILR requirement. Could you explain that? I am sure your date of 28 days before 4 December 2020 takes account of this requirement. However I would just like to know and understand.

Thanks again for your help and the info and guidance provided.

To avoid as shortfall for ILR which would then require a THIRD extension to cover a couple of months, she should apply for an extension within 28 days before reaching 30 months residence from date of entry to the UK.

If she applies too early, this will create a shortfall. An extension, when approved, is dated from the date of approval and NOT tagged onto the expiry date of her current visa.

Thank you.

Is it then the case that the minimum threshold to meet ILR criteria is 60 months in UK?

Unless personal circumstances/visa rules are not changing the extension should be applied very close to expiry to avoid any chance of shortfall over qualifying period needed for ILR.

My US wife is currently on a first stage Spouse Visa. She works on a self employed basis.

I am currently employed and earn Gross £20k per year which covers the current £18.6k earnings requirement for a future FLR(M) application. I also have an occupational pension (from previous Govt employment) of circa £9.5k per year.

My wife is self employed and has worked as such for the last 15 months. Between us, using my pension income and her last 12 months income, we would meet (exceed) the current £18.6k income requirement.

If the situation arose where the £9.5k was my sole income, how do we proof my wifes income? She does not have certified accounts. Will bank statements alone be proof? Her tax records?

I am curious.

Thanks for your help.

Use only that income and its related documents to keep your case straightforward.

Are yae no a wee bit premature in amalgamating my 2 threads? Completely different topics. Maybe keeping the 2 threads apart will help in future searches?Just a thought.........

I guess if its what you want Admin, its what you want.

Seagull, thanks for your reply.

I asked about proving the self employed income as my/our circumstances are in a state of flux. The 20k income may be under threat.

Thanks again for your response.

Grateful for any further guidance.
