leaving and reentering the UK having ILR

Post by xavior20 » Tue Nov 10, 2020 11:42 pm

Hi there,

I have held my ILR for about a year and a half.

I have claimed UC for the last 8 months and have been working part-time for the last 3 months.

I'm thinking about leaving the country for about 6 months to visit my family back home.

Whilst I'm gone, I would not claim any benefit. (ill ask them to stop paying me while I'm not in the UK)

All my travelling cost is paid for by my parents.

All my tides in the UK is my partner and a car I owned.

My question is, Will I be able to come back to the UK without any problem?

Thanks in advance

I don't understand about you asking if you can come back to the UK on the claiming benenfits board. Is this about claimaing benefits? Or about being allowed back in the UK?

If being allowed to return to the UK.

my question is because I claimed UC while I was in the UK, would that stop me from coming to the UK after leaving it for 6 months?

If you have a valid ILR, then you are allowed to claim benefits.

My undertanding is that you can live outside the UK for up to 2 years with ILR, but please wait for others to confirm this.

As you have said, you tell UC you are out of the UK and they will end you claim. You might be able to do rapid reclaim for UC when you return, if needed and if you meet the requirements. Otherwise just apply for UC again.

No, it will not stop you. You were assessed and confirmed to be qualified (excluding any deception and or fraud) hence why you get paid UC. Why would you feel it could pose a problem to your reentry admittance?
Being on UC will not get you stopped from returning.

okay so my confusion is coming from this:

(i) had indefinite leave to enter or remain in the United Kingdom when he last left; and
(ii) has not been away from the United Kingdom for more than 2 years; and
(iii) did not receive assistance from public funds towards the cost of leaving the United Kingdom; and
(iv) now seeks admission for the purpose of settlement

dose this means if I have claimed UC while I was in the UK, that might stop from reentering into the UK?
