**MN1** Applying from Outside of UK

Post by SMB10 » Tue Apr 05, 2022 2:47 pm

Hi All,

I am due to apply for ILR January 2023, currently on shortage occupation work visa.

1. Can I apply for my children who are born inside the UK for British citizenship via MN1 from outside of UK.

a. If Yes, does it affects the application in any way?
b. Whats the timeline?
c. Once the British citizenship is granted for children will I be able to apply for their passports from outside of UK?
d. My eldest is currently on tier 2 dependent visa, and we haven't applied for visa for our youngest one as we are hoping to avoid the expense and apply for the passport directly once I have got the ILR. However we are planning on visiting Pakistan for some time later this year.

Can you please advise what would be best course action considering the above situation.

Yes.
a. If Yes, does it affects the application in any way?
No.
b. Whats the timeline?
It can take up to 6 months, often longer.
c. Once the British citizenship is granted for children will I be able to apply for their passports from outside of UK?
Yes

The child will need a valid foreign passport and visa or a British passport to be able to return to the UK. And no, you cannot apply directly for a British passport for the younger child as the child is not yet British. You have to register the child as British on form MN1 first once you have ILR before you can apply for a British passport.

Thank you very much. That's very kind of you :)

If you don't mind can you also please clarify the following?

1.If the MN1 is applied from inside the UK does it gets process quicker?
a. If the Bio-metrics have already given in the dependent visa. Does the Home office still requires the biometrics for MN1?

2.Once the MN1 is approved, can I apply for passports from inside the UK even though the children are not in the UK?

It makes no difference, it is processed in Liverpool regardless of where you apply.
a. If the Bio-metrics have already given in the dependent visa. Does the Home office still requires the biometrics for MN1?
Yes, you have to take the child to enroll biometrics again.
2.Once the MN1 is approved, can I apply for passports from inside the UK even though the children are not in the UK?
You have to send any current foreign passports, so plan accordingly.

Sorry a complication has risen again and I was looking for a bit of advise.

We are pending a decision for my second child skilled worker dependant visa application. We applied 26th May and still a waiting for a decision. We have to visit Pakistan 23rd August,

1. If the decision is not already made and if we the dependant applicant leaves the country does this mean the application will be withdrawn 100 percent. Or the application COULD be withdrawn. I wasn't sure about the complete ruling

2. If the decision is made and an email has been received from the home office however the BRP is yet not received and the dependant application leaves the country this could also result the same?

3. If the application is withdrawn and I applied for the MN1 application once I receive the ILR February(2023). Does this mean the dependant can only enter the UK once he has obtained British passport by the following the MN1 route? or Can we apply for the dependant visa while the decision is still pending for the MN1 application?

1. Risky.
2. Probably okay.
3. Unsure if SW 30.1. will be satisfiable?
