Provincial Nominee

Post by Saga » Thu Feb 18, 2010 4:19 pm

Hi,

Can successful provinical nominees work in any another province in Canada?

I have been told that its only a recommendation to work in the same province but they legally they are entitled to work anywhere.

Is this correct?

Many Thanks !

There is always a lot of debate around this topic. As a Canadian Permanent Resident you have the same rights as a Canadian citizen (except for voting and holding security sensitive government positions), including right to live and work anywhere in Canada.

However, provinces would nominate, primarily for the benefit of that province. So, it is possible, but I don’t think this has ever been tested, that moving outside the province could jeopardise your PR renewal or citizenship application.

This may especially be true for Quebec. Before you get Quebec Certificate of Selection, you have to sign a declaration that you will stay in Quebec for three years. From what I have read (but don’t know for sure), if you leave Quebec within 2 years, without a strong reason (e.g. cant find a job in Quebec, etc), it may impact your PR renewal and/or citizenship application.

If you are looking at Quebec, I would strongly suggest that you plan to stay there. For any other province, I would still recommend that you don’t misuse and abuse the system and plan to stay in the province. Even if it has no impact on you, misuse and abuse of the system only make the regulation tighter and impact those who come after you.

Thanks raymasa2 for your answer ! Rest assured I am not planning to misuse. Its just a matter of deciding on probabilities for future in case I don not find a job in the province I am applying for..

I have two more questions.

1) Can I add my spouse later on after I have filed my provincial nominee application at a later date? Is it possible?

2) Is there a condition to have ONLY one type of canadian work visa ? e.g. if I have a provincial PR, can another company in any other province still apply for an 'arranged employment' visa?
In some countries, you would have to get the first visa revoked for the second to be applicable.

Many Thanks !

1) Not sure I understand the question. When you apply you have top declare all your family members, including your wife. If you dont, you cannot add this afterwards. Your wife, does not have to go with you, but she must be declared in the application.

2) Once you get the PR, you dont need another visa for Canada.

You may want to visit the official Canadian immigration website (www.cic.gc.ca).

Hi Ray,
I have just read your post which partly answers a question I posted just about an hour ago under new toppic. Being afraid that I would not be able to find job in Quebec, I wanted to explore a possibility to work elswhere in Canada as well...
However, I have not seen anywhere that you sign to stay in Quebec for 3 years. Could you please tell me where did you find the information about it. The delaration form does not specify any details as to the time of intended stay...

Thank you!
