Hello all users:
I want advise from an experienced person!
Actually i m pakistani Natuonal, my tier 4 application is pending with home office and my college is suspended frm UKBA list currently (BITE london). Recently I won a case of my child access Frm ex GF through court, my child is british (7 mnths old) and mother as well! can I withdraw my tier 4 application and apply for child access visa? Or submit separate application at same time? I m currently working full time cuz my previous visa was PSW and I m switching to tier 4. My course is starting in next few weeks. My child lives with her mother in Cardiff and my college is in london I do love my child and want to be in contact with her, and I can't maintain support of child and studies at same time! any good advise. My visa expired in July 2011. So wot r the chances? Help plz!!!!!!

Unless you have leave as a spouse (which you don't) you will have to leave the UK and apply for entry clearance as a person with access to a child. There may be options to apply from inside the UK (depending on your proportional human rights to a family life) but that would be an application made outside the rules and if granted would lead to a period of discretionary leave.

Thnx m8. So do I hve to go to Pakistan and apply? And how long it takes?

Yes, it would have to be an application in your home country. Waiting times vary but averages can be seen on the UKVISAS website.

This is not a straightforward application so make sure you have ticked all the boxes before you leave to submit the application. It requires a lot of precise (sometimes, but not always, court ordered) paperwork relevant to the contact with the child. You also have to show that you can maintain and accommodate yourself. Getting advice from a lawyer would be highly recommended. You will be permitted to work freely.

Thnx tht was a very detailed info! Well I m working currently and it's awesome job and earning good, but if I leave country I will lose it! :(
